By downloading or using the app,you acknowledge that you are fully informed of and agree to be bound by these terms of use ("Terms & Conditions"), our Privacy Policy and Community Guidelines.
These Terms & Conditions, together with the Privacy Policy, the Cookie Policy and the Code of Conduct, constitute the entire agreement between you and Kiya ("Agreement"). In case you do not agree to be bound by all of the terms of this Agreement, please do not use the Service.
We are constantly improving our services and creating new ones. This means that we may add, modify or remove products or features or services, or we may suspend or terminate services entirely. We may take any of these actions at any time and when we do, we will provide you with any prior notice.
Kiya may also terminate these Terms with you at any time and for any reason, with prior notice to you. This means that we may stop providing any of the Services to you, or impose new or additional restrictions on your ability to use the Services. For example, we may suspend your account for certain violations of laws, platform rules, and the terms you make in the app. While your account is suspended, you will not be able to use in-app services.
To receive full access to all functionalities of the Service, each Member has the option to purchase a limited, personal, non-transferable, revocable license to use diamonds (hereinafter “diamonds”). You are only allowed to purchase diamonds from us through the Service and not in any other way.
Kiya, in its sole discretion, reserves the right to charge fees for the right to access or use diamonds and/ or may distribute diamonds with or without charge. The right to use diamonds starts immediately upon the acceptance of your purchase by Kiya until termination of your account by either party, or when Kiya ceases providing the Service.
Any diamonds balance shown in your account does not constitute a real-world balance or reflect any stored value, and may only be redeemed through the Service. The transfer of diamonds is prohibited, and you shall not sell, redeem or otherwise transfer diamonds to any person or entity.
All purchases and redemptions of diamonds made through the service are FINAL AND NON-REFUNDABLE. You acknowledge that Kiya is not required to provide a refund for any reason, and that you will not receive money or other compensation for unused diamonds when an account is closed, whether such closure was voluntary or involuntary. However, if Kiya ceases providing the Service, diamonds and/or changes its business model, you will be entitled to a refund on a prorated basis.
Kiya VIP can use the privileges with VIP logo in the app for free within the validity period of VIP. VIP members will not be able to continue to enjoy this privilege if they do not renew within the specified period.
Kiya VIP's rights are limited to those who use paid accounts and cannot be transferred between Kiya accounts. It is prohibited to give, lend, lease, transfer or sell. Otherwise, Kiya reserves the right to cancel the the transferee and his/her VIP account without notice, and the relevant losses shall be borne by the transferor and the transferee.
Any VIP shall not post illegal, pornographic, violent, bloody, religious, nudity, insulting or personally offensive content in Kiya. Once found, Kiya has the right to cancel the VIP without any compensation or refund.
If you need to use auto renewable subscriptions VIP service, that means you fully understand and agree to the following statement:
This service is an automatic renewal service provided for you on the premise of getting VIP service.
If you subscribe to this service, you will be deemed to have authorized Kiya to use the iTunes account(hereinafter referred to as "account") bound to the VIP account to renew your subscription. When the VIP period is about to expire, we will charge in the next subscription period. If the above account balance is insufficient, your VIP will expire after the current subscription period.
Payment will be transferred to your iTunes account. Subscriptions are automatically renewed unless automatic renewal is turned off at least 24 hours before the end of the current period. To cancel automatic renewal, you can manually turn off automatic renewal in iTunes / Apple ID by following these steps:
Automatic renewal of Apple in App Payments (IAP payment, in app purchase): enter iPhone "Settings" - > Enter "iTunes Store and App Store" -- > click "Apple ID", select "view Apple ID", enter the "account settings" page, click "subscription", and select Kiya VIP to cancel the subscription.
